California Signs AB 2674 and AB2103 in 2013

California Governor Signs Bills   

AB 2103 has been signed into law, boosting California overtime laws.  AB 2103 clarifies that "payment of a fixed salary to a nonexempt employee provides compensation only for the employee's regular, nonovertime hours." 

Employers and employees cannot enter into an enforceable agreement to the contrary. This law overrules a court decision last year that permitted employers and non-exempt employees to agree on a salary that includes overtime.

I have a question regarding FMLA.  We have a teacher who had a baby over the summer.  She is planning to utilize the full amount of FMLA available, so she would not return until sometime in November. She is now telling us she wants to come in the full first week of school and once a month or so to do projects with the kids.  I know that leave can be taken intermittently, but do we have to allow her to work on any day that she says she would like to do so?
